Important review notice

Protective draft, not legal advice

This working draft is designed for the intended private, free, church-based learning program. It does not create a live contract or replace advice from qualified counsel. Any protection, exclusion, or limitation applies only to the fullest extent permitted by applicable law and cannot remove rights that the law does not allow a person to waive.

01

Terms of use

These Terms are intended to form an agreement between each user and [[LEGAL OPERATOR NAME]] (the “School,” “we,” “us,” or “our”) for access to the Christ Embassy Edmonton Foundation School platform. The program is private, faith-based, and currently limited to authorized church members and accepted referrals. Access is free and may be granted, refused, suspended, or ended to protect learners, the church community, the platform, or the integrity of the program.

Accounts and eligibility

  • Provide accurate account information and keep credentials confidential.
  • Use only your own account, except where an authorized guardian supports a child.
  • Notify the School promptly of suspected unauthorized access.
  • Account creation requires only the minimum registration information. Residential address and date of birth belong to the later profile-completion process and do not block initial account creation.

Program status

The Foundation School is religious education provided by the church. Unless the School expressly states otherwise in writing, it is not a degree, diploma, professional-licensing, employment, immigration, or government-accredited program. Completion, reports, or certificates do not guarantee any external recognition or outcome.

02

Privacy notice

We collect, use, disclose, retain, and protect personal information only for reasonable purposes connected with enrolment, learner support, safeguarding, course delivery, assessment, graduation, communications, platform security, and legal compliance. We will use consent and other lawful authority as required, limit collection to what is reasonably needed, and provide notice of the purposes at or before collection.

Information we may handle

  • Identity and contact details, including name, email address, and phone number.
  • Post-registration profile details, including date of birth and residential address, when requested for an explained operational purpose.
  • Guardian identity, relationship, consent, and linked-child records.
  • Course activity, progress, quiz attempts, essay submissions, grading, feedback, certificates, and graduation decisions.
  • Communications, support records, consent receipts, policy versions, security logs, device information, and essential cookie data.

Administrators and pastors may access residential addresses, dates of birth, academic records, and other administrative information only for authorized Foundation School duties. Coordinators receive contact-data access only through explicit, audited administrative assignment. Service providers may process information for us under appropriate contractual and security controls; before activation, this notice must identify material providers and any processing outside Canada.

03

Children and young learners

The program welcomes learners of all ages and its curriculum is designed without adult-themed content. For a learner under 13, protected profile completion includes a confirmation that a parent or legal guardian has consented to participation. A separate guardian account is not required for this MVP process. The School may verify consent or request additional information where reasonably necessary for safety, consent integrity, or legal compliance.

Notices and choices should be explained in age-appropriate language. Guardian consent does not permit unnecessary access to a child’s information. In the MVP, a guardian’s platform access is limited to providing and managing consent unless the School later approves a separate, tested guardian-viewing policy.

04

Communications and consent

Operational notices about account security, incomplete required assessments, course availability, safeguarding, policy changes, or service administration may be sent where permitted and necessary to deliver the program. Optional announcements, event promotions, and other electronic messages require a separate communication preference or another valid legal basis.

Where Canada’s anti-spam rules apply, a commercial electronic message will identify the sender, provide required contact information, and include a working unsubscribe method. Withdrawing optional marketing consent will not prevent essential service or safety messages. SMS is a notification channel only and standard carrier charges may apply.

05

Learning content, assessments, and certificates

Course text, video, audio, graphics, animations, quizzes, answer explanations, software, branding, and related materials are owned by or licensed to the School or their respective rights holders. Users receive a limited, personal, revocable, non-transferable right to view released materials for participation in the program. Copying, recording, scraping, redistributing, selling, publicly displaying, or bypassing view-only controls is prohibited unless authorized in writing or permitted by law.

Learning is sequential. Module completion may require all lessons, activities, and quizzes. Automated quiz results use the latest attempt; continuous assessment contributes 40% and the final examination contributes 60% under the approved grading configuration. The final examination may include manually graded essays. Passing scores, any final-exam minimum, and rounding rules are versioned administrative settings. Graduation and certificate release remain subject to final administrative approval, identity and integrity checks, completion requirements, and correction of errors.

06

Acceptable use and community safety

Users must act respectfully and must not harass, threaten, exploit, impersonate, discriminate against, or endanger another person; upload unlawful, harmful, infringing, deceptive, or malicious material; attempt unauthorized access; interfere with assessments or platform security; or use another learner’s work as their own. Suspected safeguarding, academic-integrity, or security issues may be investigated and referred to appropriate church leaders, guardians, service providers, or authorities where lawful and necessary.

Student discussions and direct messaging are disabled in the MVP. If enabled later, moderation, reporting, retention, and minor-safeguarding controls must be approved and tested before release.

07

Security, cookies, and retention

We use reasonable administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including role-based access, server-authoritative assessment rules, audit records, encryption supported by our providers, security monitoring, and restricted access to sensitive profiles. No online system can be guaranteed completely secure. Users should report suspected incidents immediately.

The platform uses essential cookies or similar technologies needed for authentication, security, accessibility, and core operation. Advertising cookies and behavioural advertising are not enabled by default. Personal information is retained only as long as reasonably required for the stated purposes, safeguarding, records integrity, dispute resolution, and legal obligations, then securely deleted or anonymized. A counsel-approved retention schedule must be adopted before launch.

Where a privacy breach creates a real risk of significant harm, the School will follow applicable assessment, notification, documentation, and mitigation duties without unreasonable delay.

08

Disclaimers, responsibility, and liability

To the fullest extent permitted by law, the platform and program are provided on an “as available” basis. The School does not promise uninterrupted availability, error-free content, a particular spiritual, educational, professional, or personal outcome, or compatibility with every device. Scheduled maintenance, security events, provider failures, internet limitations, and circumstances beyond reasonable control may affect access.

To the fullest extent permitted by law, the School and its pastors, ministers, officers, volunteers, employees, instructors, coordinators, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss arising from platform use. Nothing in these Terms excludes liability, statutory rights, or remedies that cannot lawfully be excluded or limited, and no guardian may waive a child’s non-waivable rights. Any final limitation of direct liability or indemnity must be specifically settled by Alberta legal counsel before activation.

09

Your privacy choices and rights

You may contact the Privacy Officer to ask about our practices, request access to or correction of your personal information, withdraw consent where withdrawal is legally available, change optional communication preferences, or make a privacy complaint. We may need to verify identity and may retain information where required or permitted by law. Withdrawal may affect services that depend on the information, but optional consent will not be bundled with account creation.

Requests should be made in writing. The School will respond within the period required by applicable law, subject to lawful extensions and exceptions, and will explain any permitted refusal and available review path.

10

Contact, changes, and legal details

Material changes will be versioned and presented for renewed acceptance where required. If a provision is unenforceable, the remaining provisions continue to the extent permitted. These Terms are intended to be governed by Alberta law and applicable Canadian federal law, with disputes heard in courts located in Edmonton, Alberta, subject to any mandatory law or jurisdiction that applies.
